Woman accuses New York dentist of sexual abuse in Child Victims Act suit

A woman has filed a Child Victims Act lawsuit against Buffalo, N.Y.-based dentist Robert Herzog, DDS, claiming he abused her when she was a child, according to The Buffalo News.

Nancy Peters claims Dr. Herzog sexually abused her for two or three years at his home and dental office when she was underage. Ms. Peters said she didn't tell anyone about the abuse when it occurred, and it was years before she could deal with the emotional pain of what happened.

Now 61 years old, Ms. Peters has filed a lawsuit under the Child Victims Act, a New York law that removes the statute of limitations for survivors of child sexual abuse. She said she fears there may be other victims of Dr. Herzog, whose dental license is still active.

Ms. Peters said a hygienist once walked in on Dr. Herzog kissing her. Dr. Herzog said everything was fine and the hygienist quickly left, Ms. Peters claims. The abuse stopped around the time she turned 18, Ms. Peters said.

The suit claims Ms. Peters suffered emotional distress, disgrace, and humiliation and requires continuing therapy because of the abuse.

The complaint is the only Child Victims Act lawsuit that names Dr. Herzog, and there's no indication the dentist has been criminally charged with sexual abuse. Dr. Herzog's attorney didn't respond when The Buffalo News requested comment.
