Las Vegas-based Absolute Dental has agreed to pay $3.3 million to settle a class-action lawsuit related to its data breach from earlier this year.

Absolute Dental, which has more than 50 locations across the state, discovered that an unauthorized party accessed some of its systems between Feb. 19 and March 5.

Third-party forensic investigators determined that the access originated from the accidental execution of a malicious version of a legitimate software tool, which occurred through an account associated with Absolute Dental’s third-party managed service provider.

The breach impacted the personal information of more than 1.2 million individuals.

The dental group would pay up to $5,000 per class member, according to a proposed settlement filed Dec. 19 in the U.S. District Court of Nevada.
