A federal court has ordered William Gardner, DDS, to pay $320,000 for issuing prescriptions after his New Mexico dental license was revoked and his controlled substances registration had expired.
Dr. Gardner’s license was revoked in 2019 after he was accused of submitting fraudulent claims to insurers and treating patients with a suspended license.
Between July 17, 2020, and Feb. 1, 2021, Dr. Gardner allegedly used his DEA registration number to issue 94 unauthorized prescriptions, the vast majority of which were for Schedule II narcotics. The court found him responsible for 80 of those prescriptions and ordered a civil penalty of $4,000 per violation under the Controlled Substances Act, according to a July 2 news release from the U.S. Attorney’s Office for the District of New Mexico.
