In the suit, SmileDirectClub claims dentists on the board conspired to jeopardize the company’s business. SmileDirectClub alleges a dental board investigator conducted “a series of coordinated raids” on the company’s SmileShop locations, reports Bloomberg.
The raids happened at SmileDirectClub locations in Oakland, San Francisco and Hollywood in May 2018. SmileDirectClub is arguing that the dental board does not have jurisdiction over its retail stores.
“The direct-to-consumer model supported by SmileDirect represents a serious competitive threat to their ability to continue to generate such fees through their traditional delivery model in the future,” SmileDirectClub said in the lawsuit, according to Bloomberg.
The Dental Board of California declined to comment to Bloomberg.
