Aspen Dental settles data privacy lawsuit for $18.7M

Chicago-based Aspen Dental has agreed to pay $18.7 million to settle allegations that it transmitted web user data to Meta and Google without users’ knowledge or consent.

The class action lawsuit alleged that the DSO violated privacy laws by using data tracking technology on its website to collect sensitive information about visitors and then shared that information with third parties.

There are two subclasses in the settlement, representing more than two million people. The first subclass includes individuals who booked an appointment on Aspen Dental’s website between Feb. 20, 2022, and June 1, 2023. The second subclass covers individuals who booked an appointment on the website between June 2, 2023, and Jan. 1, 2025.

The settlement received preliminary approval in June. A final hearing is scheduled for Oct. 20, 2025, according to court documents.
