Tampa, Fla.-based Coast Dental has agreed to a settlement of up to $3.84 million to resolve a class action lawsuit alleging that it sent marketing texts and calls to consumers who had asked to opt out, classaction.org reported Oct. 13.

The lawsuit, Chaviano v. Coast Dental Services, alleges that the DSO violated the federal Telephone Consumer Protection Act and Florida’s Telephone Solicitation Act. The class includes about 24,308 people who received more than one text or call within a 12-month period encouraging them to schedule an appointment after sending an opt-out request.

Eligible class members can receive a prorated cash payment of up to $59 or a voucher of up to $99 for an electric toothbrush sold by Coast Dental. Final amounts depend on how much remains in the settlement fund after expenses.

The court granted preliminary approval for the settlement Aug. 31. A final approval hearing is scheduled for Dec. 9.

Coast Dental supports more than 80 practices in Florida, Georgia and Texas.
