At the time the state board sent non-dentists performing teeth whitening services cease and desist letters that threatened legal action. The Federal Trade Commission then intervened. Additionally, the U.S. Court of Appeals for the 4th Circuit found the board’s action to be in violation of antitrust laws, according to the report.

Lawyer Hashim Mooppan defended the North Carolina system. The Supreme Court Justices voiced several questions, but a decision has yet to be reached.
