Michael Graffeo, DDS, and Harrison Linsky, DDS, MD, are equal partners in their practices: Westchester Oral & Maxillofacial Surgery and Implantology in Purchase, N.Y., and Southern Connecticut Oral & Maxillofacial Surgery and Implantology in Stamford.
Dr. Graffeo alleges that around 2020, Dr. Linsky began pursuing nonbusiness, personal matters during normal business hours. He also allegedly began using the practice’s equipment to provide independent medical exams for insurers and attorneys without producing revenue for the dental practices.
Dr. Graffeo alleges that Dr. Linsky ignored managerial and medical duties, performed some medical tasks incompetently and created a toxic work environment by mistreating staff.
Dr. Graffeo is seeking $1 million for breach of contract, breach of fiduciary duty and usurpation of corporate opportunities, the Journal reported. He is also asking the Westchester Supreme Court to dissolve the Purchase, N.Y.-based practice and disassociate Dr. Linsky from the Stamford, Conn.-based practice.
