California Dental Association to appeal decision in lawsuit against Delta Dental of California: 4 notes

The California Dental Association plans to appeal a recent decision in its lawsuit against Delta Dental of California.

Four notes: 

1. The California Dental Association filed a legal action against Delta Dental of California in December 2022, claiming that the insurer was not meeting its obligations to dental providers.

2. The lawsuit challenged the insurer’s adjustments to its Premier and PPO provider agreements, which the CDA said included fee reductions for several providers, increased administrative burdens and reduced value of benefit plans.

3. A judge ruled in favor of Delta Dental of California and dismissed the case in May, stating that the insurer does not owe fiduciary duties to its member dentists and that the insurer has the right to set or change contractual terms at its discretion.

4. The CDA said June 20 that it plans to seek dismissal of the decision.
