Court rejects dentists’ appeal against SmileDirectClub

The U.S. Court of Appeals for the 11th Circuit has sided with Nashville, Tenn.-based SmileDirectClub, rejecting the Georgia Board of Dentistry’s effort to shield itself from antitrust liability with an interlocutory appeal, reports Bloomberg Law.

Both the Georgia Dental Board and the Alabama Dental Board sought immediate appeals of the decisions in SmileDirectClub’s favor. The dental boards were seeking protection from antitrust lawsuits sometimes given to government agencies.

The lawsuit will now move forward to determine if state regulations banning SmileDirectClub’s operations are fair.
