A federal judge threw out a lawsuit filed against the city of Buffalo, N.Y., over its elimination of fluoride in its drinking water, WIVB reported Oct. 21.
Five notes:
1. A group of parents filed the lawsuit in 2023, alleging that the city was violating the state’s Green Amendment after it stopped adding fluoride to its water supply in 2015.
2. The Green Amendment was passed in 2021 to guarantee that “each person shall have the right to clean air and water, and to a healthful environment.”
3. U.S. District Judge John Sinatra Jr. found the amendment does not guarantee access to fluoridated water, adding that the amendment could also be used to argue against fluoridated water.
4. The plaintiffs’ allegations also included fraud and breach of contract, which the judge decided was not the case because the city disclosed the absence of fluoride in its annual reports to residents.
5. The city of Buffalo began adding fluoride back to its water supply in 2024.
