SmileDirectClub intends to appeal $63M arbitration award decision

SmileDirectClub is planning to appeal the decision of the Superior Court of California, which confirmed a $63 million award to Align Technology in a case involving the violation of a supply agreement.

SmileDirectClub’s chief legal officer, Susan Greenspon Rammelt, said Align procured the award through undue means and denied SmileDirectClub a full and fair hearing, according to an Aug. 24 news release from SmileDirectClub.

The court confirmed the award after finding that SmileDirectClub violated the terms of a supply agreement between the two companies. 

The company plans to file the appeal within the allotted 60-day time frame once the award is officially entered. If SmileDirectClub is successful in its appeal, Align will be responsible for any costs SmileDirectClub incurs during the appeal process, the release said. 

The bond amount to appeal is 150 percent of the original award, which is more than $94 million.
