Court approves shareholder litigation settlement involving Align: 5 things to know

The U.S. District Court for the Northern District of California granted preliminary approval of a settlement to resolve shareholder derivative litigation involving Tempe, Ariz.-based Align Technology, according to an Oct. 1 news release.

Here are five notes:

1. Align Technology and the defendants in the case have denied any wrongdoing and are not making any monetary payments except potential attorney’s fees for the plaintiffs’ council. 

2. The award for attorney’s fees could potentially be $575,000, which would be covered by Align’s insurance. 

3. As a part of the settlement, Align will adopt and maintain 17 reforms, which will remain in effect for at least three years. 

4. The settlement resolves litigation that has been pending since 2019. 

5. The final approval hearing is scheduled for Feb. 4, 2025.
